Accessible Parking: How Many Spaces, and Where They Go

The Americans with Disabilities Act is a civil rights law, not a building code, and the difference is where owners get hurt. A building code is enforced through plan review and permits; satisfy the local official and the matter is closed. The ADA has no permit process and no plan review. Compliance is determined by the Department of Justice and, when it comes to that, a federal judge, and a facility that sailed through local approval can still face federal action, because local building departments have no authority to waive or interpret away a federal civil rights obligation. The designer's stamp and the city's permit protect the owner from neither. That is the frame for everything below: these are not code minimums to negotiate but the floor of a federal right, and the owner holds the compliance risk personally.

Two land uses override the table. Hospital outpatient facilities must make 10 percent of patient and visitor parking accessible; rehabilitation and outpatient physical therapy facilities, serving patients with mobility impairments by definition, must make it 20 percent. The percentages apply to patient and visitor spaces, not the employee supply, and they do not extend to medical facilities generally.

On top of the count, the van ratio: at least one of every six accessible spaces, or fraction thereof, must be van-accessible, wider, taller, and signed as such, because a wheelchair user deploying a lift needs dimensions an ordinary accessible space does not provide.

The space itself

A car-accessible space is at least 96 inches wide with an access aisle at least 60 inches wide, surface slope no steeper than 1:48 in any direction, on a firm, stable, slip-resistant surface, marked by the International Symbol of Accessibility mounted at least 60 inches to the bottom of the sign. A van-accessible space takes one of two configurations: 132 inches wide with a 60-inch aisle, or 96 inches wide with a 96-inch aisle; either way it requires 98 inches of vertical clearance covering the space, the aisle, and the vehicular route to reach them, plus a second sign designating it van-accessible.

The access aisle is the working part of the space. It must be marked to keep parkers out of it, run the full length of the space, and lie level with it; two accessible spaces may share one aisle between them, except in angled parking, where the aisle must always sit on the passenger side of a vehicle that pulled in forward. In a structure, van clearance planning has a practical answer: all van-accessible spaces may be grouped on a single level, typically at grade, so the 8-foot-2-inch path of travel exists only where it is needed. Full route, ramp, elevator, and equipment requirements are the next module's territory.

Where they go

Location rules are where practice fails most often. Accessible spaces must sit on the shortest accessible route to an accessible entrance, and where a facility serves multiple entrances, the spaces must be dispersed so each accessible entrance has accessible parking on its shortest route: a hospital locates the outpatient spaces nearest the outpatient entrance and the employee spaces nearest the employee entrance, and both entrances must themselves be accessible. Then the provision violated most in the field: within the lot, the accessible spaces must be the closest spaces to the accessible entrance. A row of accessible stalls placed for striping convenience while ordinary stalls sit nearer the door is a violation, however common it looks.

In structures, dispersal serves safety as well as distance. Placing a few accessible stalls near the elevator core on each level, rather than concentrating them where users must travel behind rows of parked vehicles, keeps the path of travel out of the blind zone behind other cars; where stalls must sit across the drive aisle, a marked crosswalk is recommended, though not required.

The obligation does not expire

The ADA's sharpest difference from a building code: it reaches backward. Existing facilities must remove barriers where doing so is readily achievable, meaning without significant difficulty or expense, and the obligation is ongoing: what was not achievable in 1992 must be done when it becomes achievable. The Department of Justice has stated that restriping to create properly sized accessible spaces is readily achievable "in most cases," which makes the accessible-space count the least defensible noncompliance in the industry: the fix costs paint. Alterations tighten the screw further: any change affecting usability, and since the 2004 guidelines this explicitly includes resurfacing of circulation paths and vehicular ways, must be executed to current accessible specifications. The safe rule of thumb: anything taken out goes back in compliant. The full mechanics of existing-facility obligations, the grandfather provisions, and the successive-standard traps are Module 38's subject.

One frontier is still forming: the 2010 ADA Standards contain no specific requirements for accessible EV charging, and jurisdictions have been filling the gap with EV-ready and future-accessible-stall mandates of their own. An owner adding charging today should design the accessible provision in from the start and watch for the federal standard to land; the accessible-EV module tracks it.

VERDICT

In existing facilities, restripe now rather than argue later, and treat every resurfacing project as the compliance trigger it legally is. Local approval is not a defense; build to the federal floor.
